Lauren has her annual ARD coming up. I have information that is really upsetting me. We know for a fact they are not including her in the regular education class. The speech therapist that just evaluated her said she needs to be around typical children most of the day. Her old teacher told us that she didn't see Lauren much and she thought Lauren should have been in the class most of the day. I am not really that up to date on her rights in the school. I also don't understand why they are fighting so bad to keep her out of the regular class. She was fully included in VA and was finding her way alone around the halls etc. She is the only child in her school with Down Syndrome. The other children in AA are mostly Autistic. She will emulate their behavior at home and we are having a hard time with her behavior.
Anyway..do you think I should fight to get her into a regular class? I don't want to cause problems for the regular students but I also want Lauren to get the best education she can receive.

If you are dedicated to keeping her in this school, then absolutely fight. Is it in her IEP how much she is to be in the regular classroom? Like she's to be in there except for pull-outs for speech & math help - that kind of thing. If not, then have it put in there. You have ample evidence (from speech therapist) to request this type of wording. If it is in there, and they are disobeying it, then they aren't just disobeying the IEP, they are breaking the law. They will keep right on doing it if they can get away with it.

I'm a big www.wrightslaw.com searcher. I have learned soooo much looking around their sight. Always printing something or another out and droping on a teachers desk. They look at'cha w/ the deer in the head lights look. They get on the ball asap!!! Chris too is right. If it's in there and they are not doing their job, BIG TROUBLE for them!!!!!!!

Renee what does her IEP say right now as far as "minutes" for everything? Does "typical classroom" get minutes on her IEP? What grade is she in again? You know the IEP reads such that our children SHOULD have their placement with typical peers with supports whenever possible (paraphrasing but that is the jist of the law) so I don't see why if it's appropriate for Lauren to be included, be it all day or part day, they don't do it. You make it sound like her IEP already states it and they aren't adhearing to her IEP, which is a big no no and a whole other issue if you ask me. If you think it's appropriate for Lauren to be included, put it in writing and bring it to the meeting. Make them PROVE to you why she can't. The burden of proof is on the team to say why she can't be included A.

Yes, I told them last time that they had a few months to get her use to the school. Other than that they know how I feel. each time I ask the same answer is given. Her behavior is out of control. I think it is because of the peer situation. She emulates EVERYONE. I will get my stuff together this time and be ready. There is a new principal though. Not sure how she will be.
