Hi All, On another listserv, someone posted about some bumper stickers they saw and posted links to some of them. I decided to make them, since the ones I saw were not that good. So, since I do web, logo, banner, and business card designing, I decided to make some fancier ones with many different sayings. I have three different sayings and each of them have several styles to choose from. We can also do custom bumper stickers for anyone! On one site, I saw a bumper sticker that read ~

I believe some of these bumper sticketrs have been copy writed by the original owners.

The sayings themselves I do not believe have been copyrighted. I haven't copied anyones work. Thanks , Qadoshyah

They look nice.... but I am confused as to the UNO MAS on your bumper stickers.... what does that mean? Is that an ad for here?

Uno Mas is a trademarked phrase & logo and all associated graphics, information and products are copyrighted material. Uno Mas has been selling t-shirts, bumperstickers and gift products since 1998. Your use of the phrase Uno Mas on your bumperstickers is trademark infringement and legal action will be taken if you do not cease selling them immediately. For the record: "Just a little something extra" was also trademarked back in 1998, in case you were planning to plagiarize that as well.
Also, when you say you haven't copied anyone's work: Would using my company name, logo (including the font and exclamation mark) and opening a cafepress account with the words Uno Mas! and Unomas21 in your store and in the url ... you feel that none of that constitutes copying my work?
I'm shocked you didn't add three chili peppers! Apparently exchanging 3 hearts for the peppers makes all the other stuff irrelevent.
Did you notice on the homepage of this site it reads: © 2006 Uno Mas! Down Syndrome Online - All Rights Reserved
What did you think that meant? I simply can't understand how you thought that this was okay.

I did not see a bumper sticker that says "uno mas", I do indeed see "one more" but that is the english translation which is not plagarizing. You use UnoMas21 and she used one more. Confused?

You need to watch the wording in the copyright laws. Our group name has been copyrighted by other groups, but as long as our artistic approach is differen the name can be used. Here is the main disclosure in any copyright:
Copyright is a form of protection provided to authors of "original works of authorship," including literary, artistic and dramatic works, musical compositions and other creations.
Copyright protects the author's original expression as contained in the work but does not extend to any idea, procedure, process, method, system, discovery, name, slogan or title.

Unfortunately the designation on your wording and pictures states copyright, not trademarked (a "C" symbol vs "TM") There is a big difference between the 2.
The wording you specify as being trademarked is not identified as "TM", a trademark violation. Uno Mas, Uno Mas!, "One more", "a little something extra" because copyright doesn't protect titles or slogans.
Either all of this is copyright material or trademark material. From what I see on the site the copyright symbol is used, don't get the 2 mixed up.

I am not savvy on trademark vs. copyright, but It hinkt here is a bigger issue her of what is the right thing to do. If she wanted to sell bumper stickers that said any of this stuff locally or didn't advertise here, I have a hard time believing anyone would know/care. BUT, that is not the case and this is the result of it. Getting tangled up in definitions does not negate the fact that it wasn't a very nice thing to do.

Isn't she a child or teen? Sometimes kids do things innocently, without seeing the broader picture. My 13-year-old might do something like this, but she'd understand once I explained it to her. (We had a similar issue with her wanting to copy CDs.)
