Ryan is starting an after school program (sorry if it seems like I am repeating myself from another thread ) that is geared toward helping him with socialization issues. The group was started by parents of children with autism, and has grown into three locations. There is a non-profit group that runs the organization, made up of volunteer parents and professionals. I have heard good things about the program, but am completely FREAKED that he is going into a new environment.
Now the question... the paperwork to be completed contains a waiver regarding field trips and transportation. The wording is like this "In consideration of being permitted to participate in any way in field trips... I, for myself, my heirs, personal representative or assigns, do hereby release, waive, discharge, and covenant not to sue XXXXX, it's officers, employees, and agents from liability from any and all claims including (THIS IS WHAT BUGS ME) the negligence of XXXXX, it's officers, employees and agents, resulting from personal injury, accidents, or illnesses (including death)....
Then further below, in bold, it states "I understand that I am giving up substantial rights, including my right to sue".
I checked with an attorney and she said that basically if they forget to belt Ryan in and he gets hurt in an accident, I have no recourse.
For most (especially the school district) I am a P.I.T.A. parent. I've already called with a million questions for this place and have asked to observe the first few days. I know sometimes I need to just sit back and let people do their jobs, but this feels funky. Any suggestions? I was thinking of calling the director and asking if I can cross-out the "negligence" part (which I'm sure she will say "sure - but your son can't come here then...).
Any thoughts?
